These Terms and Conditions (hereinafter "Terms") govern all sales made on the website getnayade.com (hereinafter "the Website"), operated by NAYADE (hereinafter "the Seller").

Any order placed on the Website implies full and unreserved acceptance of these Terms.

Article 1 — Purpose

These Terms define the rights and obligations of both parties in the context of the online sale of products offered by NAYADE on the Website.

Article 2 — Products

The products offered for sale are described on each product page with the greatest possible accuracy. Photographs illustrating the products are not contractually binding and shall not engage the Seller's liability.

Article 3 — Prices

Prices are indicated in British Pounds Sterling (GBP), inclusive of all taxes (including VAT at the applicable rate at the time of the order). The Seller reserves the right to modify prices at any time; products are invoiced based on the prices in effect at the time the order is validated.

Article 4 — Orders

The Customer selects the products they wish to order and validates their order after reviewing these Terms. Validation of the order implies full acceptance of these Terms.

A confirmation email is sent to the Customer following payment validation.

Article 5 — Payment

Payment is made online by credit or debit card (Visa, Mastercard, American Express), Apple Pay, Google Pay, or other payment methods available on the Website.

Payment is secured via SSL encryption. The Customer's banking details are neither stored nor accessible by the Seller.

Article 6 — Delivery

Products are delivered to the delivery address provided by the Customer at the time of the order.

Estimated delivery time: 5 to 12 business days.
Shipping costs: Free delivery on orders over £100. Standard delivery (£6.99) for orders under £100.
Delivery zone: United Kingdom. Other zones may be offered on the Website.

The Seller shall not be held liable for delivery delays attributable to the carrier or resulting from force majeure.

A tracking number is sent to the Customer by email upon dispatch of the order.

Article 7 — Right of Cancellation

In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Customer has a period of 14 days from receipt of their order to exercise their right of cancellation, without having to provide a reason.

NAYADE extends this period to 60 days under its Clean Water Guarantee (see Returns & Refund Policy).

To exercise this right, the Customer must notify their decision by email to contact@getnayade.com.

Article 8 — Legal Guarantee

Products sold on the Website benefit from statutory rights under the Consumer Rights Act 2015, including the right to receive goods that are of satisfactory quality, fit for purpose, and as described.

If a product is faulty or not as described, the Customer may request a repair, replacement, or refund in accordance with the Consumer Rights Act 2015.

Article 9 — Liability

The Seller shall not be held liable for failure to perform the contract in cases of force majeure, disruption or strike of postal and transport services, flooding or fire.

Article 10 — Intellectual Property

All elements of the Website are and remain the intellectual and exclusive property of NAYADE. No person is authorised to reproduce, exploit, or use in any way, even partially, any elements of the Website.

Article 11 — Personal Data

Personal data collected during the order process is necessary for order fulfilment. It is processed in accordance with our Privacy Policy and the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Article 12 — Dispute Resolution

In the event of a dispute, the Customer is encouraged to contact us first at contact@getnayade.com to seek a resolution.

If the dispute cannot be resolved directly, the Customer may also seek resolution through an Alternative Dispute Resolution (ADR) provider.

Article 13 — Governing Law

These Terms are governed by the laws of England and Wales. In the event of a dispute, the courts of England and Wales shall have jurisdiction.
